Changes to the eviction process

There are two key implications for landlords to the tenancy eviction process, brought about by recent changes to the District Courts Act 1947

First, there is now a $200 fee for the filing of all eviction applications (previously there was no cost).

However, landlords may apply for an Attachment Order or Assessment of Financial Means to recover any monies awarded in the Tenancy Tribunal Order, and this includes recovery of the $200 fee.

The changes, which came into effect on 14 April 2014, are intended to provide swifter and more comprehensive recovery options for landlords.
